NSEL has particular expertise with mineral and mining projects. We have provided advice to the Parliamentary Commissioner for the Environment ("PCE"), the mining industry, the deep sea mining industry and inter-governmental organisations. Examples of our work in the minerals and mining sector include:

NSEL Director, Robert Makgill, appeared as legal counsel (together with co-counsel, Cymie Payne and Donald Anton) for the International Union for Conservation of Nature ("IUCN") in the International Law for the Sea Tribunal ("ITLOS") deep sea mining proceedings in Hamburg, Germany, 2010. Robert, and his co-counsel, submitted a written statement addressing the responsibilities and obligations of States sponsoring private entities undertaking deep sea mining within the High Seas in August 2010. They presented oral arguments to the Seabed Disputes Chamber of the ITLOS in September 2010. The Advisory Opinion released by the Chamber on 1 February 2011 strongly endorsed many of the legal arguments put forward by legal counsel for the IUCN.
Advised the Parliamentary Commissioner for the Environment on legal aspects of the findings and recommendations in the report "Stockton revisited: The mine and the regulatory minefield". This involved a review of the previous mining regime as well as the regime under the Crown Minerals Act 1991.
Advising Waikaia Gold Limited on the establishment and operation of a fluvial gold mine in Southland. Multiple consents are required from both the regional and territorial authorities. NSEL provided strategic advice on the scope of the application and expert reports. Consent applications have been filed and a joint hearing has been set down before the regional and district councils.
Assisting Youngson and Associates Limited with due diligence advice on exploration investment in New Zealand, proposed gold mining ventures in the South Pacific and contractual arrangements with joint venture partners.
